As postsecondary institutions address harassment, sexual violence, and student privacy rights, new and pressing policy issues continue to emerge at the federal, state, and institutional levels.
Through reviews and communications, the U.S. Department of Education Office of Civil Rights (OCR) has learned more about the challenges that campuses faced after issuing the April 2011 Dear Colleague Letter (2011 DCL), 2013 Montana Resolution, and a resolution from a school district in Arcadia, California.
These reviews presented new lessons and concerns for OCR, leading to the issuance of another OCR guidance document aimed at the higher education community: Questions and Answers on Title IX and Sexual Violence.
In light of the 2014 Guidance and calls from campuses to offer more clarity on OCR’s request for Title IX compliance, this Legal Links issue brief serves as a supplement to the NASPA/ELA January 2014 Legal Links brief.
In this brief, authors review and discuss several critical areas covered by the most recent 2014 OCR Guidance. The areas covered review and expand on existing compliance requirements, as well as cover new issues of critical importance to student affairs practitioners.
